Terms of Use
Please read these terms carefully before using the echo99 website or macOS app.
These Terms of Use ("Terms") govern your use of echo99 (the "Service"), operated by Wirenode s.r.o. ("we," "us," or "our"). By accessing the website, downloading the app, or using echo99, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
echo99 is a macOS menu-bar application for recording calls, creating separate local audio tracks, and generating local transcripts and speaker labels. The current version is designed to run on your Mac without an account, cloud upload, meeting bot, or subscription. The Service also includes this website, downloads, documentation, and related support.
The Service is provided on an "as is" basis and may change over time.
2. User Responsibilities
You are responsible for how you use echo99 and for the files created on your device. You agree to:
- Ensure that recording, transcription, and speaker labeling are lawful in your jurisdiction and context.
- Notify and obtain consent from call participants where required by applicable law.
- Protect your Mac, local recordings, transcripts, and backups from unauthorised access.
- Use the Service only for lawful purposes and in compliance with all applicable laws and regulations.
Age requirement: You must be at least 16 years old to use the Service. If you are under 18, you confirm that you have parental or guardian consent.
3. Acceptable Use
You agree not to use the Service to:
- Record calls without consent where consent is required by law.
- Create, store, or share content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
- Infringe intellectual property, privacy, publicity, or other rights of third parties.
- Harass, impersonate, deceive, or harm another person.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code except where permitted by law.
- Interfere with the website, downloads, support systems, or the integrity of the Service.
4. Availability and Changes
We may modify, suspend, or discontinue the Service or any part of it at any time. Because echo99 runs locally on your Mac, you are responsible for keeping copies of your recordings, transcripts, and generated files. We are not responsible for local data loss caused by device failure, deletion, operating-system changes, third-party software, or backup configuration.
5. Third-Party Services
echo99 may record audio from calls taking place in third-party apps or services such as Zoom, Google Meet, Microsoft Teams, browsers, or other conferencing tools. echo99 does not control those third-party services and is not responsible for their availability, policies, terms, or technical changes. Your use of those services remains subject to their own terms and privacy policies.
6. Data Ownership and Privacy
Your recordings, transcripts, labels, and related output remain your property. In the current local app, these files are stored on your Mac, and we do not use your meeting content to train large language models. Our handling of personal data is described in the Privacy Policy.
7. Payment
The current downloadable version may be offered for free. If we introduce paid plans, paid downloads, or subscriptions, the applicable price, renewal, cancellation, refund, and tax terms will be presented before purchase and may be governed by additional terms.
8. Intellectual Property
The Service, website, app, design, text, trademarks, and functionality, excluding your data, are owned by Wirenode s.r.o. or its licensors and are protected by copyright, trademark, and other laws. You agree not to remove, alter, or obscure proprietary notices.
9. Indemnification
You agree to indemnify and hold harmless Wirenode s.r.o. and its officers, directors, employees, agents, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising out of or related to your use or misuse of the Service, your violation of these Terms, your violation of applicable law, or your recording or processing of calls without proper notice or consent where required.
10. Limitation of Liability
To the maximum extent permitted by law, Wirenode s.r.o., its directors, employees, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, use, goodwill, or business interruption, arising out of or in connection with the Service. Your sole remedy for dissatisfaction with the Service is to stop using it.
11. Severability
If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions will remain in effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.
12. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page and revise the "Last updated" date. Continued use of the Service after changes take effect means you accept the revised Terms.
13. Governing Law
These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the competent courts of the Czech Republic.
